TERMS OF USE

IMPORTANT: Please read these Terms carefully. By purchasing, accessing, or using any Headlight Restoration Academy product, course, community, website, or resource, you agree to be legally bound by these Terms.
1. Agreement to These Terms
These Terms of Use (“Terms”) are an agreement between you and Headlight Restoration Academy LLC (“HRA,” “Academy,” “we,” “us,” or “our”). They govern your purchase of and access to HRA websites, online courses, videos, downloads, templates, trackers, guides, private communities, coaching materials, and related products or services (collectively, the “Services”).
By checking an acceptance box, completing a purchase, creating an account, entering the HRA private community, or otherwise accessing any Service, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy. If you do not agree, do not purchase or use the Services.
2. Eligibility and Account Responsibility
You must be at least 18 years old and legally capable of entering into a binding agreement. You must provide accurate account information and keep your login credentials secure. Each purchase is licensed to one individual only unless HRA expressly agrees otherwise in writing.
You may not share, sell, lend, transfer, sublicense, or allow another person to use your account or login credentials. You are responsible for all activity occurring through your account and must promptly notify HRA through the Contact Us page if you suspect unauthorized access.
3. Purchases, Payment, and Refund Policy
All prices are shown at checkout and are due when charged. You authorize HRA and its payment processor to charge the payment method you provide for the amount displayed at checkout, including applicable taxes.
ALL SALES OF TIER 1 AND TIER 2 COURSES ARE FINAL AND NON-REFUNDABLE, EXCEPT WHERE A REFUND IS REQUIRED BY APPLICABLE LAW. Because digital access and proprietary materials may be provided immediately, dissatisfaction, failure to complete the course, lack of use, scheduling conflicts, or failure to achieve a desired result does not create a right to a refund.
If a separate subscription product is offered, its price, billing interval, renewal terms, and cancellation method will be disclosed at checkout. Canceling a subscription stops future renewals but does not retroactively refund charges already incurred unless required by law.
4. Course Access and Meaning of Lifetime Access
A qualifying course purchase includes lifetime access to the purchased course. “Lifetime access” means access for as long as HRA continues to own, operate, and make that course available. It does not mean the purchaser’s lifetime, guarantee that every platform or feature will remain unchanged, or prevent HRA from updating, reorganizing, replacing, or retiring content for legitimate business, legal, security, or technical reasons.
Lifetime access remains subject to these Terms. HRA may suspend or terminate access if you violate these Terms, infringe intellectual property rights, misuse the Services, initiate fraud, or create a safety or security risk. Access lost because of a violation will not be refunded.
5. Ownership, Copyright, and Limited License
The Services and all associated materials—including videos, recordings, demonstrations, written lessons, scripts, photographs, graphics, diagrams, worksheets, downloads, templates, trackers, spreadsheets, databases, the Year/Make/Model Difficulty Guide, branding, site design, and the selection and arrangement of content—are owned by or licensed to HRA and are protected by copyright, trademark, and other intellectual-property laws.
Your purchase does not transfer ownership of any content. HRA grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the purchased materials solely for your own education and to operate your own headlight restoration business.
Without HRA’s prior written permission, you may not:
Copy, reproduce, duplicate, download where downloading is not expressly enabled, screen-record, photograph, record, capture, or archive course or community content;
Share your login, provide access to another person, display the course to a group, or distribute any file or link that permits unauthorized access;
Post, upload, publish, transmit, email, sell, resell, license, sublicense, rent, give away, or otherwise distribute HRA content, in whole or in part;
Modify, translate, adapt, reverse engineer, remove ownership notices from, or create derivative materials substantially based on HRA content;
Use HRA content to create, teach, market, or improve a competing course, membership, guide, certification, coaching program, training library, or digital product;
Use automated tools, bots, scraping, extraction, artificial intelligence systems, or data-mining methods to collect, reproduce, summarize at scale, train on, or repurpose HRA content; or
Represent HRA content, methods, branding, certificates, or materials as your own or imply that HRA endorses, employs, franchises, certifies, or partners with you unless HRA has agreed in writing.
These restrictions do not prevent you from applying what you personally learn to perform headlight restoration services or operate your own business. Any limited use permitted by applicable law remains subject to that law. HRA reserves all rights not expressly granted.
6. Enforcement of Intellectual-Property Rights
HRA may investigate suspected unauthorized use and use reasonable technical and account-security measures to protect its content. A suspected or confirmed violation may result in immediate suspension or permanent termination of course, download, and community access without refund. HRA may also issue takedown notices and pursue injunctive relief, damages, costs, or any other remedy available by law.
You agree to reasonably cooperate with an investigation into account sharing, piracy, fraud, or misuse. HRA’s decision not to enforce a provision on one occasion does not waive its right to enforce it later.
7. HRA Private Community Access
Eligible course purchasers receive access to the HRA private community as an included benefit. Community access is personal, revocable, and subject to these Terms and any posted community guidelines. It is not a separately purchased ownership right and may be modified, moved to another platform, paused, or discontinued.
Community discussions may contain opinions and user-generated information that HRA has not verified. You remain responsible for evaluating any business, technical, legal, financial, or safety information before relying on it.
8. Community Rules
To protect a useful and professional environment, you agree that you will not:
Harass, threaten, bully, discriminate against, shame, stalk, or personally attack another member, instructor, customer, employee, contractor, or third party;
Use hateful, obscene, sexually explicit, violent, or intentionally disruptive language or content;
Post spam, repetitive promotions, unsolicited offers, affiliate links, misleading claims, scams, malware, or unrelated advertising;
Solicit members for competing courses, paid communities, coaching, products, employment, or services without HRA’s written permission;
Share or repost another person’s private information, customer information, messages, images, job details, pricing, or business data without authorization;
Copy, record, screenshot, redistribute, or publish private-community discussions or materials outside the community without permission from HRA and the affected member;
Impersonate HRA, an instructor, another member, or any other person, or falsely claim credentials, results, endorsements, or affiliations;
Encourage illegal, fraudulent, deceptive, unsafe, or unethical conduct, including misleading customer warranties or claims;
Interfere with the platform, bypass access controls, scrape member information, collect members’ contact details, or use community information for mass marketing; or
Contact, solicit, interfere with, review-bomb, market to, or otherwise target NextGen Headlight Restoration, its customers, leads, employees, contractors, accounts, or business relationships based on information learned through HRA.
Members may respectfully disagree and share their own results, provided they remain truthful, professional, and constructive. HRA may remove content that it reasonably believes violates these rules or creates legal, safety, privacy, reputational, or operational risk.
9. Warnings, Suspension, and Permanent Bans
Depending on the nature, severity, frequency, and impact of a violation, HRA may take one or more actions: remove content; issue a warning; limit posting privileges; temporarily suspend community or course access; or permanently ban the user from the community and terminate access to any or all Services.
HRA may impose an immediate permanent ban without a prior warning for serious conduct, including content theft or duplication, account sharing, piracy, threats, harassment, hate speech, fraud, doxxing, scraping, security circumvention, unauthorized solicitation, impersonation, illegal activity, or interference with NextGen Headlight Restoration or its customers and business relationships.
Access restrictions or bans resulting from a Terms violation do not entitle the user to a refund, credit, transfer, or replacement membership, except where required by law. HRA may consider a written appeal submitted through its Contact Us page, but is not obligated to reverse an enforcement decision.
10. User Content and Community License
You retain ownership of original content you post. By posting it in an HRA-controlled community, you grant HRA a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, and distribute that content as reasonably necessary to operate, moderate, protect, and promote the community and Services. HRA will seek additional permission before using a member’s name, likeness, testimonial, or identifiable business results in paid advertising, except where already authorized by a separate release.
You represent that you own or have permission to post your content and that it does not violate another person’s copyright, trademark, privacy, publicity, contractual, or other rights.
11. Educational Purpose; No Business or Income Guarantee
The Services are provided for educational and informational purposes. HRA does not guarantee that you will start a business, obtain customers, earn revenue or profit, recover your purchase price, achieve a particular restoration result, or obtain any other outcome. Examples, earnings discussions, case studies, and results are illustrative only and are not promises of typical or future performance.
Your results depend on factors outside HRA’s control, including your effort, skill, experience, market, pricing, equipment, products, customer service, advertising, compliance, and business decisions. You are solely responsible for your decisions and for obtaining appropriate legal, tax, accounting, insurance, safety, and other professional advice.
12. Safety and Professional Responsibility
Headlight restoration may involve chemicals, aerosols, tools, sanding materials, vehicles, electrical components, and outdoor or mobile work conditions. You are responsible for reading and following product labels, safety data sheets, equipment instructions, laws, environmental requirements, and appropriate personal-protective-equipment practices. Do not perform work you are not trained, equipped, insured, or legally authorized to perform.
HRA is not responsible for property damage, vehicle damage, bodily injury, exposure, customer disputes, warranty claims, citations, regulatory issues, or business losses arising from your acts, omissions, products, services, or reliance on the Services.
13. Third-Party Platforms, Products, and Links
The Services may reference third-party websites, platforms, software, products, suppliers, or services. HRA does not control and is not responsible for third-party availability, terms, privacy practices, pricing, performance, safety, or content. A reference or link does not necessarily constitute an endorsement. Your use of third-party services is governed by their terms.
14. Service Changes and Availability
HRA may update course lessons, instructors, community features, downloads, technology, or other parts of the Services. HRA does not guarantee uninterrupted, error-free, or permanently archived access. Temporary interruptions may occur because of maintenance, security, platform outages, events beyond HRA’s control, or necessary updates.
15. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” HRA DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RESULTS. NOTHING IN THESE TERMS EXCLUDES A WARRANTY THAT CANNOT LAWFULLY BE EXCLUDED.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HRA AND ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, INSTRUCTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, CUSTOMERS, GOODWILL, OR BUSINESS OPPORTUNITIES; OR DAMAGE ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HRA’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID HRA FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO THE LIMITATIONS APPLY ONLY TO THE EXTENT PERMITTED BY LAW.
17. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless HRA and its owners, members, managers, employees, contractors, instructors, affiliates, and service providers from third-party claims, losses, liabilities, damages, judgments, penalties, and reasonable costs, including attorneys’ fees, arising from your violation of these Terms; your business, products, services, advertising, warranties, customer work, or community conduct; your infringement of another person’s rights; or your unlawful or negligent acts or omissions.
18. Termination
You may stop using the Services at any time. HRA may suspend or terminate access as stated in these Terms. Provisions that by their nature should survive termination—including ownership, license restrictions, payment obligations, disclaimers, limitations of liability, indemnification, governing law, and enforcement rights—will survive.
19. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Unless applicable law requires otherwise, any legal proceeding arising from these Terms or the Services must be brought in a state or federal court with jurisdiction over Brevard County, Florida, and each party consents to that court’s personal jurisdiction and venue.
Before filing a claim, you agree to send HRA a written description of the dispute through the Contact Us page and allow 30 days for a good-faith attempt to resolve it informally. This informal-resolution requirement does not prevent either party from seeking urgent injunctive relief to protect intellectual property, confidential information, safety, or security.
20. Changes to These Terms
HRA may revise these Terms from time to time. The updated Terms will be posted with a new effective date. Material changes will apply prospectively and may also be communicated through the website, account, community, or email. Your continued use of the Services after revised Terms become effective constitutes acceptance to the extent permitted by law.
21. Miscellaneous
These Terms, together with the Privacy Policy, checkout disclosures, and any product-specific terms presented at purchase, form the entire agreement concerning the Services. If a provision is found unenforceable, it will be modified only as much as necessary and the remaining provisions will remain effective. You may not assign these Terms without HRA’s written consent. HRA may assign them in connection with a merger, acquisition, reorganization, sale of assets, or transfer of the Services. Headings are for convenience only.
22. Contact
Questions, legal notices, reports of copyright infringement, community reports, and appeals may be submitted to Headlight Restoration Academy LLC through the Contact Us page on the HRA website. Include your full name, account email, order number if applicable, a clear description of the issue, and any supporting information.
